Bringing an Unfair or Constructive Unfair Dismissal Claim

We are obliged by the Solicitors Regulatory Authority (SRA) to provide details of our fees in respect of bringing this claim.

It is difficult to provide you with a precise indication as each case is different in its complexity. The amount of documents and the number of witnesses involved will not only affect the time required to prepare the claim for the hearing but, also the time it takes an Employment Tribunal to hear the claim.

However, a standalone ‘ordinary’ Unfair Dismissal Claim which does not include any other head of claim, may cost between £12,000 to £20,000 plus VAT including disbursements comprising of counsels fees and travel costs.

We charge on a time basis which is set in accordance with the seniority of the solicitor handling the matter.  O

Bringing a Wrongful Dismissal Claim.

We are obliged by the Solicitors Regulatory Authority (SRA) to provide details of our fees in respect of bringing this claim.

We rarely bring a stand-alone Wrongful Dismissal Claim in the Employment Tribunal because the compensation is capped at £25,000.  As such the costs are likely to be disproportionate to the value of the claim.

However, if we were to bring a stand alone claim for Wrongful Dismissal which, does not involve any other head of claim, the costs are likely to be in the region of £8,000 to £15,000 plus VAT including disbursement comprising of counsel and travel costs.

We charge on a time basis which is set in accordance with the seniority of the solicitor handling the matter.  

Insurance

Some people have legal expenses cover included in their insurance policy which covers employment matters.  As such you should check your insurance policies to see if this is included.  Insurance may offer the services of their panel solicitors. However, in most cases they will permit you to select your own solicitor.
